  1. Introduction
    1. We welcome you to use our online bill payment facility (Online Payment Facility) to pay your accounts with Butlers.
    2. We endeavour to make your bill payment process a secure and convenient experience, and invite you to carefully read these Terms and Conditions which govern the use of this Online Payment Facility.
  2. Accepted Credit Cards
    1. We currently accept the use of the following credit cards for payment of your Butlers accounts through the Online Payment Facility: Visa, Mastercard, Paypal
  3. Information provided by you
    1. We require you to provide us with certain information about yourself when you use the Online Payment Facility to make payment of your bills. This information may include your name, credit card number, bill number, account number and other personal particulars. We use this information to ensure that the bill payment process is carried out accurately and efficiently.
    2. If you do not wish to provide us with the required information, you will not be able to make further use of the Online Payment Facility to pay your bills.
    3. If you wish to use our Online Payment Facility, you agree to ensure that any information provided by you will be complete and accurate. You will not at any time provide us with information which is false, inaccurate, misleading, obsolete or deceptive. If we have reasonable grounds to believe that you have not provided us with accurate information, we may choose not to proceed with the processing of your payment and the relevant bills will remain outstanding.
  4. Making a Payment
    1. It is your responsibility to have sufficient cleared funds available in your account to permit the debiting of the authorised amount.
    2. Online payments authorised on or before 5.00pm on a business day will be debited from the nominated account on that business day.
    3. Online payments authorised after 5.00pm on a business day, or on a day other than a business day, will be debited from the nominated account on the next business day. The date of receipt will be the same as the day that you authorised the online payment.
    4. If you change your account and want to continue making online payments, it is your responsibility to inform us of these changes.
    5. If any account is not paid within 14 days, it will incur either:-
      1. a book-keeping fee of $30.00; or
      2. interest at the rate of 12% per annum, calculated on the balance outstanding, from the date of the account to the date that payment is received; whichever is the greater.
  5. Confirmation of Payment
    1. You will be issued with a receipt reference upon your payment being successfully processed. This is your record of your payment. Butlers does not consider that a bill has been paid until it issues you with a receipt reference and if you do not receive a receipt reference you should process your payment again or pay your bill by another means.
  6. Security
    1. Your payment information is protected using a Verisign certificate, which is the data encryption technology used by many online payment systems. Generally this is determined by a lock icon displayed at the bottom right of your web browser. This website uses a frame based web development approach which prevents the icon from being displayed. To verify that the security is indeed active, you should right click on the Pay By Web frame and select properties. This will display the page's details including certificates and connection (security) details.
    2. We use all reasonable endeavours to ensure the integrity of the Online Payment Facility's Security. Despite our endeavours breaches of security and confidentiality could occur. You acknowledge that we are not liable for any loss suffered by you as a result of any breaches in security.
    3. If you are uncomfortable with using the Online Payment Facility, we suggest that you choose another method to pay your Butlers™ accounts. Please contact our Accounts Department on +61 8 9386 5200 if you require any assistance.
  7. Passwords
    1. You are required to maintain the confidentiality and secrecy of any user access codes or passwords (Passwords) which we may issue to you, and you will be fully responsible for all acts or omissions that are conducted by any party under or using your Passwords.
    2. You agree to immediately inform and notify us of any unauthorised use of your Passwords.
    3. We may at any time change your Passwords without notice if we believe it is necessary to ensure the security of our computer systems or services.
  8. Defects in Online Payment Facility
    1. We will not in any way be liable for any delay, disruption or defects in the Online Payment Facility.
    2. You acknowledge that you assume all the risks involved in using our Online Payment Facility and we will not be in any way liable for any damage, loss, expense or detriment caused (directly or indirectly) by a defect in our Online Payment Facility.
  9. Exclusion of Warranties and Implied Terms
    1. Except as expressly provided to the contrary in these Terms and Conditions, all terms, conditions, warranties, undertakings, inducements or representations, whether express, implied, statutory or otherwise, relating in any way to the Online Payment Facility are excluded.
    2. Without limiting the generality of the above, we will be under no liability to you in respect of any loss or damage (including consequential or economic loss or damage) which may be suffered or incurred by you or which may arise directly or indirectly in respect of services supplied pursuant to these Terms and Conditions or in respect of a failure or omission on our part to comply with our obligations under these Terms and Conditions.
    3. Where any legislation implies in these Terms and Conditions any term, condition or warranty, and that legislation avoids or prohibits provisions in a contract excluding or modifying the application of or exercise of, or liability under such term, condition or warranty, such term, condition or warranty will be deemed to be included in these Terms and Conditions. However, our liability for any breach of such term, condition or warranty will be limited, to making the Online Payment Facility available to you again.
    4. You warrant that you have not relied on any representation made by us which has not been stated expressly in these Terms and Conditions or upon any descriptions or illustrations or specifications contained in any document including any catalogues or publicity material produced by us.
  10. Amendments to Terms and Conditions
    1. These Terms and Conditions may be updated or amended by us at any time. We will not provide notice of any such change.
  11. Service Contracts
    1. These Terms and Conditions do not in any way waive or reduce your obligations stipulated in any other agreement which you have entered into with Butlers.
  12. Acceptance
    1. The commencement of your use of the Online Payment Facility constitutes acceptance of these Terms and Conditions. If you do not agree to these Terms and Conditions please do not use the Online Payment Facility.
