The cost of getting divorced

If you have been separated from your spouse for over 12 months, you may be considering whether or not to apply for a Divorce. There are a number of factors you need to consider before applying for a Divorce, but one thing people usually do not consider is the actual cost to file a Divorce Application.

As of 1 July 2019, the filing fee for a Divorce Application has increased to $910.00.

However, you may be eligible for a reduced fee of $305.00 if you can show the Court that you either meet the fee concession criteria, or you are experiencing financial hardship. You will be required to complete an additional form for a fee reduction.

You meet the fee concession criteria if:

  1. you are the primary cardholder of a:
  2. Health Care Card
  3. Pensioner Concession Card
  4. Commonwealth Seniors Health Card, or
  5. any other card issued by Centrelink or the Department of Veterans’ Affairs that entitles you to Commonwealth health concessions.
  6. Or, if you are receiving:
  7. Legal Aid
  8. Youth allowance
  9. Austudy payments, or
  10. Abstudy payments.

When filing a sole Application for Divorce, only the person who is making the Application will have to show that they meet the fee concession criteria or that they are experiencing financial hardship, to be eligible for the reduced fee.

When filing a joint Application for Divorce, both parties will need to meet the fee concession criteria or prove they are both experiencing financial hardship to be eligible for the reduced fee.
